Regulations for Travel Agents
- General Provisions:
1.1. These terms and conditions define the rules for the provision of services by the Travel Agent (hereinafter referred to as the "Agent"), acting as an intermediary between the client (hereinafter referred to as the "Client") and tour operators, carriers, hotels, and other entities offering tourist services.
1.2. The Agent operates in accordance with the laws applicable in the Republic of Poland, particularly the Act of November 24, 2017, on Package Travel and Linked Travel Arrangements.
1.3. The Agent is not a tour operator and is not responsible for the performance of services provided by third parties.
- Scope of Activity:
2.1. The Agent provides services in the following areas:
- Intermediation in the purchase of package holidays,
- Booking of airline, train, and coach tickets,
- Booking of accommodations (hotels, apartments, guesthouses, etc.),
- Providing information on travel insurance conditions and facilitating the purchase of policies,
- Travel advisory services, including assistance in selecting offers tailored to the Client's preferences.
- Agent’s Obligations:
3.1. The Agent provides services in the following areas:
- Intermediation in the purchase of package holidays,
- Booking of airline, train, and coach tickets,
- Booking of accommodations (hotels, apartments, guesthouses, etc.),
- Providing information on travel insurance conditions and facilitating the purchase of policies,
- Travel advisory services, including assistance in selecting offers tailored to the Client's preferences.
3.2. The Agent is not liable for:
- Changes made by the tour operator or other service providers,
- Non-performance or improper performance of services by third parties,
- Administrative decisions or other actions by government authorities affecting the execution of services.
- Client’s Obligations:
4.1. The Client is obliged to:
- Provide true and complete information necessary for booking or other services,
- Thoroughly review the terms of the agreement concluded with the tour operator or other entity,
- Comply with visa, passport, customs, and sanitary regulations applicable in the destination countries,
- Make timely payments for the services ordered.
- Booking and Payment Rules:
5.1. Booking of tourist services is made upon the Client’s acceptance of the terms of the offer and these terms and conditions.
5.2. The Client may make payments via:
- Online payment,
- Bank transfer to the Agent's designated account.
5.3. Payment terms and schedules may be individually arranged depending on the offer.
- Cancellation and Reservation Changes:
6.1. The Client has the right to cancel or modify a reservation in accordance with the conditions specified by the tour operator or other service provider.
6.2. Any costs associated with cancellation or changes to reservations are determined by the agreement with the tour operator.
6.3. The Agent undertakes to assist the Client in the process of cancellation or reservation changes.
- Personal Data Protection:
7.1. The Agent processes the Client's personal data in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR).
7.2. The Client's personal data is used solely for the execution of the agreement and communication with the Client.
7.3. The Client has the right to access, correct, request deletion, or restrict the processing of their data.
- Complaints:
8.1. Complaints about services provided by the Agent can be submitted in writing, electronically, or in person at the Agent’s office.
8.2. The Agent undertakes to respond to complaints within 14 business days of receipt.
8.3. For complaints regarding services performed by tour operators or other entities, the Agent forwards the complaint to the appropriate institution and informs the Client of the outcome.
- Final Provisions:
9.1. These terms and conditions come into effect on the date of their publication on the Agent’s website.
9.2. The Agent reserves the right to amend these terms and conditions. Such changes will take effect upon publication, provided they do not affect the rights of Clients arising from reservations made prior to the changes.
9.3. Any disputes arising from the implementation of these terms and conditions will be resolved by the competent common court in accordance with applicable law.
